Things That A Bailiff Must Not Do In Their Interactions With The Mandator

On November 1, 2022, the Minister of Justice issued Circular 08/2022/TT-BTP on the Code of Professional Ethics for Bailiffs.
In particular, it stipulates what a bailiff must not perform the following acts in relation to the mandator, including:
1/ Harassing, causing difficulties, and troubling mandators.
2/ Receiving or demanding any additional money or benefits from the mandator out of the costs already recognized in the contract.
3/ Receiving money or any other benefit from a third person to make or not fulfill a request
4/ Accepting the request if the request's purpose and content violate the laws, are contrary to social morality, and are not in accordance with the duties and powers of the bailiff.
5/ Preparing certificate of proof, verifying civil judgment enforcement conditions, and organizing the enforcement of court judgments and decisions relating to the bailiff's own interests and benefits to the mandator or its relatives including: wife, husband, biological children, adopted children; biological father, biological mother, adoptive father, adoptive mother; grandfather, grandmother, grandfather, grandmother; uncle, aunt; and brother, sister of a bailiff or of husband, wife of a bailiff; grandchild whose bailiff is grandpa, grandma, aunt, uncle.
6/ Consulting, inciting, colluding, and creating conditions for the mandator to perform illegal acts, infringing upon the legitimate rights and interests of other organizations and individuals.
7/ Pressuring, coercing, deceiving, threatening, discounting, or promising to entice a mandator to use the service.
8/ Colluding, collaborating with the mandator or related people to falsify the contents of the certificate of proof, the work record performed, or doing other fraudulent acts.
9/ Intentionally carrying out a sentence's decision or content in a different way; delaying or extending the period allotted for execution without justification.
10/ Other tasks that are forbidden by the laws.
Circular 08/2022/TT-BTP takes effect from December 22, 2022
