On September 29, 2022, the Minister of Construction issued Circular 03/2022/TT-BXD, guiding the functions, tasks and rights of assigned construction organs belonging to the Provincial People's Committees and District People's Committees.

1/ Accordingly, the assigned construction organs belonging to the Provincial People's Committee include:

– The Department of Construction is a specialized organ, belonging to the Provincial People's Committee. The Department of Construction performs the staffing function to assist the Provincial People's Committee in the state administration of: construction planning, architecture, construction investment activities, urban development, infrastructure, houses, offices, the real estate market, and construction materials…

– The Department of Construction of Hanoi and the Department of Construction of Ho Chi Minh City do not perform the staffing function to assist the City People's Committee in the state administration of construction planning and architecture.

 2/ The Department of Planning and Architecture of Hanoi City and the Department of Planning and Architecture of Ho Chi Minh City are specialized organs belonging to the City People's Committee, performing the function of staffing and assisting the City People's Committee in the state administration of construction planning and architecture.

 3/ The Department of Transport – Construction is a specialized organ belonging to the provincial People's Committee. It performs the function of staffing and assisting the Provincial People's Committee in the state administration of construction and performing the tasks and rights related to construction in the local area. (For other fields under the Department of Transport – Construction, it shall comply with the guidance of the ministry managing the respective sectors and fields)

The addition of the Department of Transport – Construction is in line with the pilot policy of merging the Department of Transport with the Department of Construction in some localities.
